The Role of the State Medical Board and the Insurance Company

In some states, you are required

to notify the state medical board

and then you'll also, especially as a radiologist, um,

make sure that who's ever in charge of the, the documents

or the information or the images doesn't destroy any of

that material, that it's safeguarded until you can get it

to, uh, your lawyer.

Um, the next thing that happens, uh, you know,

so we, we know that immediately the insurance company is

going to, uh, appoint an attorney to represent you.

You may or may not know that person, uh,

but they're typically the ones you're, you're not having

to go out on your own and find a lawyer.

Your insurance company is typically going to say, okay,

we're appointing this person.

That person's gonna reach out to you,

and then you're off and running.

Um, you will then meet with that attorney, um,

and it's a pri that's where the privilege starts.

You are having, you know, open

and honest conversations with that lawyer

and moving forward, you're going to be reviewing images

and reports with that lawyer.

And this process is in large part, to teach your lawyer

what the issues are.

I mean, you're probably gonna have a pretty savvy,

medically knowledgeable attorney representing you,

but you also want to, you know, talk about the case

with specific detail and the issues that you see and,

and they'll take you through that process.

But the next thing I'm going to encourage you to do

is to read your policy.

You need to understand what your rights

and obligations are under your specific insurance policy.

And one of those things is to understand

what are the policy limits

and do you have a right to simply say,

please resolve this case.

Sometimes you don't get to make that decision
