Welcome back to the Medicolegal Primer for radiologists.
0:05
We're about to start part two of the course.
0:08
Let's get right into it with the introduction.
0:11
So part two is entitled, you've Been Sued.
0:16
Now What? Alright, so you've gotten the notification
0:21
that you're gonna be listed in a malpractice suit.
0:24
Now what? So part two includes lectures on the
0:29
elements of a lawsuit, what to do
0:32
and what not to do when you're sued, I'm sorry, laws
0:37
and patient communication prior to resolution of a case.
0:42
And this will be taught by Steven Brown, alternate forms
0:47
of resolution besides patient communication
0:50
and I'm sorry, laws that will be discussed by Kelly.
0:54
And then I will be talking about how to behave at trial
0:58
with, um, some input from my wife Kelly.
1:03
So what are the goals and objectives of part two?
1:05
Uh, you really have to understand the critical concepts
1:09
of a lawsuit, which are duty, breach, causation and damages.
1:13
You're gonna learn the litigation process
1:15
and your role as a defendant
1:17
and how you can help your lawyer.
1:18
The, the best propose different forms of resolution of the
1:23
Complaint, which include saying I'm sorry to the patient
1:26
and trying to resolve it on that basis.
1:28
But then there are the other alternatives,
1:30
which include mitigation and arbitration
1:32
and something that's called candor laws.
1:36
And then we will hopefully coach you on how
1:39
to best defend yourself in and out of the courtroom.
1:44
Um, my role as course director three,
1:46
five years in academic practice.
1:48
I've made lots of mistakes.
1:49
I was named in only one suit
1:51
and that was as a fellow and quickly dropped.
1:54
I've been an expert witness on several depositions
1:57
and trial testimony
1:58
and had hundreds of conversations with my spouse.
2:02
So with regard to Kelly Uson, the my spouse,
2:06
she is the course director's director.
2:09
She's had 35 years in legal practice
2:11
and was a prosecutor in the state of Ohio
2:14
and defense counsel for Personal injury law
2:16
before becoming a plaintiff malpractice law
2:19
while in Colorado.
2:20
She's reviewed thousands of cases, had lots
2:23
of personal experience and hundreds
2:24
of conversations with me.
2:27
Steven Brown is our faculty member
2:31
who is an associate professor of radiology
2:33
and attending radiologists at Boston Children's Hospital.
2:38
Steven's interesting in
2:39
that he's also a clinical ethicist in the center
2:42
of bioethics for Harvard Medical School,
2:44
and Steven has written a number of publications about
2:48
communicating bad news to patients.
2:51
So that's your lineup for part two and let's get at it.
